SHORT DESCRIPTION: Notice of Public Utility Commission of Texas (PUC) Docket No. 54300, Petition to Direct Disbursement of PURA Chapter 39, Subchapter N Proceeds Designated for ATG Clean Energy Holdings Inc.

LONG DESCRIPTION: Staff of the PUC (PUC Staff) has filed a petition in PUC Docket No. 54300, Petition to Direct Disbursement of PURA Chapter 39, Subchapter N Proceeds Designated for ATG Clean Energy Holdings Inc.  In its petition, PUC Staff seeks a PUC order directing ERCOT to disburse to all parties with valid claims the proceeds from the transaction under subchapter N of chapter 39 of the Public Utility Regulatory Act (PURA)[1] that are designated for ATG Clean Energy Holdings Inc., including proceeds designated under the name Green Energy Exchange.  To effectuate this requested relief, all interested parties must establish in this proceeding their claims to such proceeds. Upon resolution of all such claims, PUC Staff will request an order directing ERCOT to distribute the proceeds under such terms as may be ordered by the PUC. PUC Staff further recommends that any unclaimed funds be used by ERCOT to reduce the amount of Securitization Uplift Charges that will be paid by wholesale market participants. 

The presiding Administrative Law Judge has set a deadline of November 29, 2022 for all interested parties to file Motions to Intervene in the PUC proceeding and respond to the petition. 

ERCOT issues this Market Notice to all Market Participants, consistent with the requirement in Order No. 1 that ERCOT provide a Market Notice regarding this PUC proceeding.
