Description: This Planning Guide Revision Request (PGRR) amends Section 5.2.2 by providing that an Entity will not be eligible to initiate or maintain a Generator Interconnection or Modification (GIM) if the Entity or any other owner of the project meets any of the company ownership (including affiliations) or headquarters criteria listed in the Lone Star Infrastructure Protection Act, Texas Business and Commerce Code, Sections 113.002(a)(2)(A)-(b)(2)(B) or 2274.0102(a)(2)(A)-(b)(2)(B), added by Act of June 18, 2021, 87th Leg. R.S., Ch. 975 (S.B. 2116). An Entity will also not be eligible to initiate or maintain a GIM if the real property to be utilized by or for the project is owned or controlled, in whole or in part, by an Entity that meets any of the above-mentioned criteria. Any Entity that seeks to initiate a GIM will be required to submit an attestation confirming that it does not meet the statutory criteria. If there are changes in the ownership or headquarters location of the Interconnecting Entity (IE), then the new IE will be required to submit an attestation confirming that, despite the changes, it does not meet the statutory criteria. Finally, an attestation form is added in Section 8, as Attachment D, Attestation Regarding Compliance with the Lone Star Infrastructure Protection Act.
